Rich Dude Sues An Escort For Not Being Julia Roberts

lindseydlRobert Brot, a businessman in his mid-50s, thought all his hard work had paid off when he met a Southern redhead with "natural DDD" boobs who needed his money to get back on track. Lindsey De Leon said she was into Brot and the relationship proceeded accordingly... until De Leon started falling tiptoeing back into her previous life.

In a recently-filed lawsuit, Brot alleges that he "loaned" De Leon more than $100,000 to help her act together and that she still owes him most of the money, even though she apparently never signed a contract:

At first, DeLeon did what she knew best -- landing a job as a stripper and doing escort work on the side to pay off her debt to him, Brot said.

A concerned Brot told her that if she married him, he would waive the debt. She replied that she would think about it and agreed in the meantime not to go back into the escort trade, the suit alleges.

But by July, she was selling herself again, he learned. [NY Post]

We can just hear Judge Judy now: "You're suing her, it seems, sir, for not living up to your standards. I'm happy that you have standards, but unless you had an agreement for debt repayment, you're out of luck."

Or something like that. The point is, we're scratching our heads trying to figure out what kind of a case Brot, sympathizing though we are with his heartbreak, could possibly have. After all, what judge is going to believe that a guy gave a woman he loved $100,000 and also expected it paid back?

He tried to force her to marry him unless she payed her debt back! When he finished, did he tie her to the railroad tracks and twiddle his moustache?

Mr. Brot should thank his lucky stars. If she had married him, it would have cost him a lot more than writing off the $100K loan to get rid of her. Talk about sending good money after bad.

I don't know what evidence Brot has or can develop, but an oral loan contract is enforceable if a jury believes such an agreement was made (and assuming its terms don't run afoul of whatever version of the Statute of Frauds applies in that jurisdiction). I had a similar type of case once -- not involving an escort, but an engagement gone bad -- where the man alleged that money given to the woman (my client) was a loan, and she said it was a gift. It would have gone to trial, except he also had subsequently given her a release for all claims he had against her, and the court dismissed his claim. So Brot's suit may well have merit, depending on the surrounding circumstances.
