I Guess We'll Never Write About Her Again

Hey guys, I just got my first cease-and-desist letter! It was from "the people" of a certain bisexual reality TV star whose name I can no longer use because, apparently, it's trademarked.

I guess they're going to have to write me another letter if they want me to take down the post accusing her of being a Vegas call girl. In the mean time "my people" are looking into it.

A bit of poking on the internet indicates Pardo is something like a third-year associate at the Davis Firm, which is a small shop that apparently represents C-list celebrities.  IP is not my area (and I'm not giving you legal advice), but I'm not aware of any trademark case arising out of news reports and commentary.  If you were selling a product with her image, you'd have a problem.  On that theor, Coca-Cola could shut you down for saying you hate the taste of Diet Coke (which, of course, is trademarked) and for illustrating your commentary with a picture of a Diet Coke can.  I assume you didn't lift a copyrighted picture from her website, right?  (Which, if you did, would be a copyright issue, not a trademark issue.)
